MALPRACTICE NEWS
Jury Sides With VA Podiatrist in Malpractice Case
Case description: The plaintiff, a 44-year-old woman, experienced an inversion injury of her left ankle and fell on the sidewalk in front of her home. She immediately experienced pain and swelling in the ankle. The next day, she presented to the defendant podiatrist for evaluation. She reported that this injury was the third such injury she had experienced in the last seven years. The plaintiff also showed the defendant a video of the ankle injury that had been captured on her doorbell video camera. When a subsequent MRI demonstrated significant abnormalities in all three lateral ankle ligaments, the defendant recommended surgery to stabilize the ankle and help prevent similar injuries in the future.
The planned surgery included placing anchors in the talus and fibula to attach an internal brace. While the defendant was preparing the drill hole in the talus to receive the anchor, the bone developed a fracture, which the defendant immediately identified and reduced. As a result of the fracture, the anchor could not be placed, so the ankle ligaments were repaired solely with sutures. The fracture healed uneventfully. Within three months of surgery, the plaintiff reported going hiking in Colorado without...

RESPONSES/COMMENTS (NON-CLINICAL)
RE: Clinical Phronesis (the practical wisdom required to achieve optimal patient outcomes.)
From: Rod Tomczak, DPM, MD, EdD
An international journal titled Medicine, Health Care and Philosophy published an article titled, “Discovering Clinical Phronesis”. The authors are from McGill University in Montreal and Centre Hospitalier Universitaire Vaudois in Lausanne, Switzerland. The five authors used a Delphi technique to evaluate eleven sets of transcripts of semi-structured interviews of physicians respected by their peers for their clinical excellence and involved in teaching medical students and residents.
The product of these interviews, called phronesis can be defined as a ‘practical wisdom’ and what is needed to bring about a good outcome with patients. Five findings in the examination of the eleven “excellent physicians” were overwhelmingly identified as common to all eleven. These five elements included ethos or character of the physician, clinical habitus or know how, encountering the patient with attentiveness, modes of reasoning amidst complexity, and embodied perceptions such as intuitions or experience-based medicine.
Phronesis dates back to Aristotle and is understood in the broad sense as a way of knowing and acting in a practical sense. “Practical” is contrasted with abstract reasoning such as is found in pure mathematics or philosophy. Phronesis is required to recognize moral virtues and values such as bravery, generosity, truthfulness, and justice. This reflects Aristotle’s pillars of ethics which is not surprising considering that Aristotle’s father was a...

RESPONSES/COMMENTS (ETHICAL ISSUES)
RE: The Ethical Propriety of APMA Officers' Endorsement of a Product or Service
From: Allen M. Jacobs, DPM
There has been some discussion regarding the ethical propriety of APMA officers endorsement of a product or service. Such endorsements are legal, but are they ethical? There is usually a difference. There is a difference between a podiatric physician advertising a service or product personally as opposed to the creation of an appearance that the APMA itself endorses that product or service.
The ethical obligations of the APMA president are substantially greater. If the APMA president receives money, stocks, gifts, or other benefits, the endorsement may create or appear to create a financial conflict of interest. This is a concern. IT MUST BE DISCLOSED. The presidential title may create the suggestion that the product is endorsed by the APMA rather than the personal opinion of the president.
Any reward in exchange for endorsement, promotion, or the sale of a product or service, regardless of form, should ethically be declared.
The APMA Code of Ethics states clearly:
AE1.0 Conflict of Interest
An APMA member rendering volunteer or compensated services to APMA or its component association(s) provides truthful disclosure of actual and potential conflicts of interest and...

RESPONSES/COMMENTS (THE ART OF PODIATRY) - PART 1A
From: Gary S. Smith, DPM
I agree with Dr. Jacobs that epinephrine is fine for digital surgery, but I don't use it for two reasons. First, because it really doesn't seem to make a difference in blood flow that is worth the risk, and second, why set yourself up for a possible lawsuit? Whether it's right or wrong, there is no shortage of podiatrists willing to testify that you committed malpractice by using epinephrine.
Gary S. Smith, DPM, Kane, PA
RESPONSES/COMMENTS (THE ART OF PODIATRY) - PART 1B
From: Keith Gurnick, DPM
There exists a plethora of well-written published journal articles that state not to use epinephrine in toes, fingers, or nasal and ear procedures. Many feel these articles are old and outdated and rely on mis-information or prior poorly done studies, or just anecdotal fear. There are also many rebuttal articles indicating it is safe when used under the proper circumstances. Then there also are suggestions on when to avoid using epinephrine in a local anesthetic digital block, such as in diabetics with small vessel disease, patients with the diagnosis of Raynaud's syndrome, in the presence of infection, and also with patients on non-selective beta-blockers or tricyclic antidepressants.
When using a local anesthetic with or without epinephrine for a digital block, we have all been taught and we have learned to use the least amount of volume and in the lowest dosage to get the job done.
