MALPRACTICE NEWS
From: Vince Marino, DPM
Although now retired, over the past 36 years of practice, I have performed hundreds of ankle stabilization surgeries. The defendant podiatrist was fortunate enough to have a defense verdict. I HIGHLY suggest that EVERY patient undergo a course of conservative care prior to any surgical procedure, no matter how unstable an ankle seems.
Not only is it well documented that many ankles improve, it protects you from the situation described in this case. It never hurts to be conservative at first in cases of ankle instability, including a course of physical therapy. Nobody would ever fault you for first being conservative prior to any surgery.

RESPONSES/COMMENTS (ETHICAL ISSUES)
From: Bret Ribotsky, DPM
Dr. Jacobs raises an important question, and I agree with him on the central point: any financial or material benefit tied to an endorsement must be disclosed. Transparency is the foundation of trust, and the APMA Code of Ethics, particularly AE1.0 and AE3.0, rightly requires it. Where a real conflict exists, it should be identified, managed, and, where appropriate, recused. I would add some perspective, however. Many of the strongest spokespeople and leaders in our profession are also people with ties to political organizations, industry, and other outside groups. Those relationships are often what make them effective advocates. They bring visibility, resources, and relationships that benefit the profession. A connection is not, by itself, a conflict, and it should not disqualify a colleague from serving or speaking.
Nor should we penalize those who give generously of their time. Our officers and volunteer leaders devote countless unpaid hours to this profession. If someone would ordinarily receive a benefit for their work in a similar role, denying it solely because they also volunteer would punish service. The standard should not be that volunteers must forgo every benefit they would otherwise have earned. It should be that those benefits are disclosed and that reasonable steps are taken to eliminate or manage conflicts of interest.
I suggest a practical framework:
1. Disclose all compensation, equity, gifts, or other benefits connected to an endorsement.
2. Distinguish clearly between a personal opinion and an official APMA position, so no one mistakes one for the other.
3. Manage conflicts through recusal where the Code requires it.
4. Preserve the ability of dedicated volunteers to participate without being shut out of legitimate opportunities.
Disclosure and good-faith management protect our members and the public while still allowing our best people to lead. I thank Dr. Jacobs for prompting this discussion.

RESPONSES/COMMENTS (NON-CLINICAL)
From: Allen M. Jacobs, DPM
More from Sir William Osler and his teachings and advice to young doctors: "You have entered the profession of medicine with a view of obtaining a livelihood; but in dealing with your patients, let this always be a secondary consideration."
"You are in this profession as a calling, not as a business, a calling which exacts from you at every turn self-sacrifice, devotion, love and tenderness to your fellow man. Once you get down to a purely business level, your influence is gone and the true light of your life is dimmed. You must work in the missionary spirit, with a breadth of charity that raises you above the petty jealousies of life."
And finally: "I warn you against the trials of the day soon to come to some of you - the day of large and successful practice, Engrossed late and soon in professional cares, getting and spending, you may so lay waste to your powers that you may find, too late, with hearts given away, that there is no place in your habit-stricken souls for these gentler influences which make life worth living."
Allen M. Jacobs, DPM, St. Louis, MO

RESPONSES/COMMENTS (OBITUARIES) - PART 1
It's always sad to see a friend and a distinguished podiatrist pass away. He was a good old friend. I want to send my sincere condolences to his family and tell them how sad I was to hear about his loss. He is also a major loss to the Texas Podiatric Medical Association.

RESPONSES/COMMENTS (OBITUARIES) - PART 2
I am deeply saddened by the loss of my good friend Larry Newmann. He was a giant of a man with a personality to Match. He was kind, gentle, and always had a smile, warm handshake, or joke for everyone.
We met in undergrad at Roosevelt University and established a life-long friendship. He was the Editor-in-Chief of the Ilioped - our senior yearbook at ICPM. He was a successful podiatrist who loved our profession and helped thousands of patients. He morphed into a college professor who influenced many of his students to become podiatrists. Larry and his wife Ann were a perfect match.
Rest in Peace my friend. You will be mourned by many.
